Terms & Conditions

All work carried out by Fernhill Ltd is subject to the below mentioned terms and conditions.

Legal Notice

These conditions govern all “contracts of agreement” made through Fernhill Ltd who are consultants in the hospitality industry of serviced accommodation.  It is known that Fernhill Ltd is the legal entity of Oakdale Serviced Apartments.  Oakdale Serviced Apartments are managing agents, booking agents and property providers of serviced accommodation. Information is passed between the two.  


Fernhill Ltd act as “consultant” for the property owner (“you”) (“landlord’) (“leaseholder”).  The extent of consultancy services issued by Fernhill Ltd will be determined by the contract signed between both parties.


The property owner will not operate as a short term accommodation provider within a pre-agreed  radius of a managed Oakdale Serviced Apartment until three years of contract completion has passed between both parties.

It is understand that Fernhill Ltd does not provide legal or tax advice and formal representation should be sought independently.


Reasonable care has been taken that the content of the Fernhill Ltd website and/or other means of promotion or advertising, is correct but it is subject to amendment at any time without notice.  All content on the Fernhill Ltd website and/or other means of promotion or advertising is published in good faith. 


Fernhill Ltd may link to other websites and are not responsible for the data policies, content, or security of these linked websites.


The accommodation

  1. It is understood that the property owner will receive all permissions required under the terms of any such property lease and/or mortgage before entering a contract with Fernhill Ltd.

  2. It is understood that the property owner establishes and receives permission by license approval if required to do so to operate as a furnished holiday let before entering a contract with Fernhill Ltd. 

  3. The property owner will obtain the appropriate property insurance cover for the furnished holiday let prior to renting the property including sufficient cover for both Employers Liability and Public Liability.

  4. The property will be made available for at least 140 days in any one year to paying third parties as short term accommodation / A furnished holiday let.   

  5. The property owner will be responsible for ensuring that their upholstered furniture meets the requirements set out in The Furniture and Furnishings (Fire) (Safety) Regulations 1988.

  6. The property owner will be responsible for ensuring the property meets The Electrical Equipment (Safety) Regulations 1994

  7. The property owner will be responsible for ensuring the property meets The Gas Safety (Installation and Use) Regulations 1998 if supplied at the property.

  8. The property owner will be responsible for ensuring the property meets The Smoke and Carbon Monoxide Alarm (England) Regulations 2015.

  9. The property owner will comply with BS5410 if supplying oil burners at the property and will have oil-fired appliances and equipment inspected by someone who can complete an OFTEC CD/12 Landlord Oil installation check form.

  10. The property owner will be responsible for ensuring the property has adequate heat and/or smoke detection on every floor of the property in line with legislation for their location. 

  11. The property owner will be responsible for obtaining a PAT Certificate for all electrical portable appliances annually.

  12. The property will be responsible to ensure that all products provided in their property meet the General Product Safety Regulations 2005 


Insurance and Liability

  1. All warranties, conditions and other terms implied by statute of common law or otherwise are, to the fullest extent permitted by law, excluded from any contract with Fernhill Ltd and these conditions shall apply in their place.  Nothing in these terms and conditions limits or excludes the liability of Fernhill Ltd for death or personal injury resulting from negligence; or for any damage or liability incurred by you because of fraud or fraudulent misrepresentation by Fernhill Ltd, or any liability that cannot by law be excluded.

  2. Subject to the paragraph above, Fernhill Ltd shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss or corruption of data or information, or any special indirect, consequential, or pure economic loss, costs, damages, charges or expenses.

  3. The property owner  shall indemnify Fernhill Ltd against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by Fernhill Ltd arising out of or in connection with you, or your business’, breach of statutory duty, misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of your Furnished Holiday Let shall be limited to the fees paid to Fernhill Ltd.

  4. Fernhill Ltd shall not be liable for any failure or delay in performance of its obligations which results directly or indirectly from any cause or circumstance which is beyond its reasonable control affecting the completion of the set-up of your holiday let business.

  5. Events beyond Fernhhill Ltd control shall include but is not limited to: Act of God, Outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken at the property, strikes, lockouts or boycotts, embargo, blockade.

  6. Other than in relation to death or personal injury caused by Fernhill Ltd negligence, or any other liability that by law cannot be excluded or restricted, Fernhill Ltd liability to you in relation to these conditions is limited to the fees paid to Fernhill Ltd.

Privacy Statement

  1. We may use your contact details to keep in touch with how business is doing and whether we can provide any further services for you from time to time. This will be done via email.  Should you not wish to be contacted you can email us at info@fernhillltd.co.uk

  2. We do not pass your details onto third parties


Quality & Feedback

  1. Fernhill Ltd are committed to providing the best service possible for our clients and conduct regular audits to ensure that high standards are maintained. 

  2. We welcome feedback from our clients that may also be used to promote our business. 


Complaints

  1. Fernhill Ltd aim to deliver the best possible service, but in the unlikely event that you are dissatisfied with the service offered, you should notify us in writing by email as soon as possible. 

  2. A complaint received by us in writing will be responded to within 3 working days of receipt advising how we intend to address the issue. Complaints received in writing will receive Director level attention.


General

  1. We reserve the right to change these conditions from time to time.

  2. These conditions shall be governed by and construed in accordance with the laws of England and the Courts of England shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these conditions and any matter arising from them.

  3. All content on this website is deemed the property of Fernhill Ltd.  None of the information on this site may be reproduced  other than downloading our contact details may be taken without prior permission.
